Lumber Company Defrauds Government, Owners Sentenced to Prison

Adam Martignetti, 44, was sentenced to a year in prison by a Trenton, NJ federal court last Thursday, October 12th. In a possibly laughable turn of events, Martignetti was charged with committing the same crimes his boss, Robert R. Dattilo, was also charged and sentenced for almost two years ago.

In the case at hand, Martignetti and Dattilo (part-owners of Bayway Lumber) committed separate acts of mail and wire fraud in basically the same way. Apparently, they would send “gifts” to their customers, and then add the cost of those gifts to their bill. They would also overcharge for items, or deliver more than what their customers had ordered, again charging more.

Not only are these actions considered fraud, Bayway Lumber’s customers included Rutgers University, The New York Transit Authority, Con Edison, the New York Department of Corrections, Amtrak, the city of Elizabeth, and the Plainfield Board of Education, just to name a few.

Dattilo was sentenced to three years of supervised release, and Martignetti received a one-year prison sentence. Both men must also repay the institutions, organizations, and public entities that they defrauded.
